The drug’s patent on sildenafil expired last week, meaning the drug is available to consumers in its generic form. The patent expires at the end of this month, though, so the FDA still has to approve the drug for sale. Sildenafil, the generic version of Viagra, is the most popular drug on the market.
In a news conference in Philadelphia, Dr. John Lechleiter, MD, chair of the department of obstetrics and gynecology at the University of Pennsylvania, said that the patent for the generic form of the drug is worth fighting for, but not for, patents that expired in the past two years.
“I know we have to be vigilant about getting our drugs through the FDA,” he said.
Viagra, he said, should not be sold as a generic drug. The drug should instead be approved for sale through a generic drugstore, he said.
In addition to the patent, other generic drugmakers have filed for patents on sildenafil and vardenafil, the latter being available through the Food and Drug Administration as a prescription drug. Sildenafil, the generic version of Viagra, is also available as a generic drug and is also available through the same pharmacy, he said.
“When the patent expires, it’s going to be more difficult for people to get a generic drug. It’s going to be more difficult for us to get a generic drug,” Dr. Lechleiter said. “But it’s a big deal if we can get people to do the same.”
Viagra and its generic versions of Sildenafil, vardenafil and tadalafil have been available since 1998, when the original patent was granted.
The new patent for the generic form of the drug expires at the end of this month. Since that date, the generic drugmaker has not yet received approval for sale in the U. S. market.

But some analysts say that generic drugs don’t always work for everyone, and generic drugmakers need to be wary of making their own decisions on their own.
“When a pharmaceutical company has a patent on a drug and the FDA allows the drug to go on sale, you have a very difficult situation,” said Dr. Nachum Katlowitz, director of research and development at the Pharmaceutical Research and Manufacturers of America.
“It’s difficult to be on a good drug, even when there are generic versions of the drug, and then you have a lot of pressure on the government,” he said.
“I’ve seen companies do things like that, in the past, but they don’t always work as well as they used to,” said Dr. Aaron Kesselheim, a professor of medicine at the University of California, San Francisco.
He said that, even in the United States, there are many drugmakers that sell generic drugs, and that is true in some states.
Dr. Katlowitz said that’s the main reason why generic drugmakers need to be cautious about making decisions on their own.
“The way generics are produced is that they’re produced by a number of different manufacturers, and you have to have a way to ensure that the generic drug is as safe as possible,” he said. “It’s just not possible to make that a simple matter of one manufacturer.”
There are other reasons why the FDA’s approval process may not be as smooth as that of generic drugs. The FDA approval process can be lengthy and can take several months or even year, depending on the pharmacy and the dosage.
“The problem is that they don’t have that information in the way that generics do,” Dr. Katlowitz said.
“They don’t have that information in the way that generics do, and they have to be approved for sale by the FDA,” he said.
If a generic drugmaker is approved for sale through a generic drugstore, it can then sell that drug on its own, but it must also meet certain criteria to be approved for sale.
